(“Wasser’s,” “we,” “us,” or “our”)
These Terms & Conditions govern all sales, orders, deliveries, and use of our website (wassersfurniture.com). By placing an order or using our website, you agree to these terms.
Changing or Canceling an Order
Need to change or cancel your order? Contact us by email at info@wassersfurniture.com or call 954-454-9500 between 8:30 AM and 5:00 PM, Monday through Friday (excluding holidays), within 24 hours of placing your order. We will do our best to accommodate your request.
If you are unable to change or cancel within 24 hours, your order is considered non-cancellable.
Orders canceled after they have been placed with the manufacturer are subject to a 25% cancellation, handling, and restocking fee. All cancellations involving shipped items are subject to round-trip shipping charges. If the item qualified for “Free Shipping,” we will charge our actual outbound shipping costs.
Special order products (including items with selectable fabrics, leathers, finishes, or custom specifications) are non-refundable and non-cancellable after 24 hours.
Floor Sample Products: These are previously used showroom display items and may have imperfections. We make every effort to disclose known issues via photos and descriptions. Floor samples are sold “as is” and are final sale — non-cancellable, non-refundable, and non-returnable. By purchasing a floor sample, you acknowledge and accept the possibility of imperfections.
Special Order Items & Deposits
The majority of items at Wasser’s are custom-made or special-order. A 50% non-refundable deposit is required on all special orders. Orders generally cannot be canceled after 24 hours.
Special delivery requirements (e.g., specific timing or access challenges) are handled case-by-case. It is the client’s responsibility to ensure adequate entry, elevators, stairwells, doorways, and clearances. Clerical errors or pricing mistakes are subject to correction before or upon confirmation.
Payment Terms
A minimum 50% deposit is required on all orders unless otherwise agreed in writing. The remaining balance is due in full prior to delivery or shipment. All payments are non-refundable except as expressly stated in these terms. Title to all goods remains with Wasser’s until full payment is received and the goods are delivered from our premises.
Shipping & Delivery
We offer home delivery service throughout Florida and can arrange nationwide delivery via freight. We can also ship to your freight forwarder or provide a custom freight quote.
Delivery dates are estimates only and subject to change. We are not liable for delays caused by manufacturers, carriers, or events beyond our control. Delivery will be scheduled in advance. If no one is available to accept delivery on the agreed date, you will be responsible for all transport and re-delivery charges.
You are solely responsible for:
- Ensuring adequate access and entry to your premises (including elevators, stairwells, doorways, and hallways).
- Verifying that the furniture fits in the desired rooms and through all access points.
- Clearing the delivery area of existing furniture or obstacles (our delivery team does not move or dispose of your items).
Any additional costs (e.g., lift gate, stairs beyond standard, or special equipment) are your responsibility. If delivery cannot be completed due to access issues, the items will be returned to our warehouse, and you will be invoiced for all related transport and re-delivery fees. A 50% deposit must be maintained on all undelivered goods at all times.
If you arrange your own shipping, title and risk of loss pass to you upon pickup or loading from our premises.
International Orders
Duty, customs tariffs, VAT, and other taxes are the buyer’s responsibility and are calculated based on the destination country’s regulations. You will be notified of estimated fees by our broker upon customs clearance.
Delays & Force Majeure
Production and shipping delays can occur, especially with high-end, custom, or imported items. We will make reasonable efforts to provide accurate lead times and notify you promptly of any delays. However, we are not responsible for delays caused by manufacturers, suppliers, carriers, or other third parties. Under no circumstances will Wasser’s be liable for any consequential, indirect, or incidental damages resulting from delays.
We are not liable for delays or non-performance caused by events beyond our reasonable control (force majeure), including but not limited to acts of God, pandemics, strikes, supply chain disruptions, weather, or government actions.
Delivery Acceptance & Damage Claims
We work with reputable manufacturers and carriers to ensure your items arrive in excellent condition. However:
- All deliveries must be signed for by you or an adult (18+) you designate.
- You must thoroughly inspect the items before signing the delivery receipt.
- Any visible damage, shortage, or issue must be noted clearly on the delivery receipt/waybill at the time of delivery.
- Save all original packaging until the inspection period ends.
If damage is noted on the receipt, you may reject only the damaged piece(s) while accepting the rest. We will, at our discretion, provide replacement parts or arrange a replacement. Failure to note damage at delivery or retain packaging may void any claim against us, and you may need to file directly with the carrier. We are not responsible for damages not properly reported. Concealed damage must be reported to us in writing with photos within 72 hours of delivery.
Returns & Refunds
Due to the custom nature of most products, returns and refunds are not accepted except as expressly provided in the “Changing or Canceling an Order” section above. Floor samples and special-order items are final sale. All sales are final once production has begun or items have shipped.
Governing Law
These terms are governed by the laws of the State of Florida. Any disputes shall be resolved exclusively in the courts located in Broward County, Florida.
Limitation of Liability
To the fullest extent permitted by law, Wasser’s shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your purchase or use of our products.
